Biography
Johan Zwemmer is a lecturer and researcher at the department of employment law and lawyer at Stibbe in Amsterdam. In 2012 he obtained his doctoral degree in his dissertation 'Plurality of employership'. In this he investigated the content and meaning of the employer in situations where on the part of the employer simultaneously or successively different parties are involved in the execution of the employment contract. This can be the result of the contractual agreements made with the employee (temporary employment, secondment and payrolling), the group membership of the employer, the transfer of the company in which the employee works and / or the legal merger or division of the employer. On the basis of legislation, legislative history and European and national case law, it has been examined whether the interests of the employer and the employee in these situations of plurality of employership are adequately taken into account.
