Biography

Anna van Duin (1985) joined the Center for the Study of European Contract Law (CSECL) as a PhD candidate in September 2015. After graduating from Leiden University (LL.M in Civil Law, cum laude) and the University of Oxford (Magister Juris), Anna has worked as a research and teaching assistant at Leiden University's Europa Institute. From 2009 to 2015 she worked as an attorney-at-law for Pels Rijcken & Droogleever Fortuijn, specializing in Dutch civil (procedural) law, (private) international law and fundamental rights. She was one of the co-editors of the 24th edition of Hugenholtz/Heemskerk (2015), a leading handbook on Dutch civil procedure. Anna has a special interest in private law remedies, European civil procedure and access to justice, topics she has regularly been invited to speak about. At CSECL, Anna participates in Prof. Dr. C. Mak's Vidi-project 'Judges in Utopia. Judicial law-making in European private law'. In her PhD project, Anna investigates the functions of Article 47 of the EU Charter of Fundamental Rights - the right to an effective judicial remedy - in European private law adjudication, more particularly cases concerning remedies under the Unfair Contract Terms Directive (93/13/EEC). She focuses on the process of linking national remedies to (breaches of) EU rights, and the use of Article 47 as an instrument for national judges to balance interests and reach a decision in private legal disputes. She will specifically look at enforcement on the national level before the national civil courts of selected Member States: the Netherlands, Spain and the United Kingdom (England & Wales).
