Biography
Roberto Branco Martins (7 June 1977) obtained a degree in Dutch law from the University of Amsterdam in 2003. His specialization was private law and Europe. During his studies he worked at a recruitment and selection office for lawyers and did an internship at a legal consultancy firm that was active in the international practice of professional football. His thesis topic "The first European CLA in professional football" led to an employment contract with the Federation of Paid Football Organizations (FBO), the employer organization in professional football. At the FBO he worked for two years as European Affairs manager and he developed two projects that were funded by the European Commission with a subsidy, he became project manager of the projects "Promoting the Social Dialogue in European Professional Football" and "Promoting the Social Dialogue". in the European Candidate Countries ". During the research component of these projects, he came into contact with the T.M.C. Asser Institute for international private law and since 2003 he is involved in the Asser international sports law center. After working for a year at a law firm in Amsterdam, he decided to work as a director of an interest group for players brokers, Pro Agent. Nowadays he also works for the international variant of this organization, the European Football Agents Association. In addition to these activities, Branco Martins works as Assistant Professor in Work and Sport at the University of Amsterdam. His course is part of the Master in Labor Law but is also open as an elective for students at the UvA or professionals from the field. Branco Martins conducts his doctoral research at Edge Hill University North West England. He is also part of the Center for Sports Law Research. Professional sport in the European Union is a sector that falls under a forest of rules. Companies and employees active in the sector are covered by Association Regulations, Labor Legislation, European Law, and many other sources of regulation. The football sector in the European Union is characterized by a high degree of mobility of employees, the international character of the labor market, flexibility in employment relationships, relatively young employees, an international compensation system for the transition of employees, disciplinary sanctions through arbitration committees, etc. The forest of rules in combination with this sporting specificity means that there is legal uncertainty in the European labor market in football. The search for legal certainty is central to the PhD research. The European Social Dialogue is being examined as a possible instrument for creating legal certainty: a European collective labor agreement in football.
