Biography
David Leathers is a Managing Director with Alvarez & Marsal Disputes and Investigations in Houston, with over 20 years of experience assisting companies, boards of directors, individuals and legal counsel with the economic, valuation and accounting issues that arise during transactions, disputes and investigations. He has testified in both federal and state courts throughout the U.S., as well as in arbitration matters, and has expertise in several fields. Mr. Leathers has experience with oil and gas valuation, intellectual property damages, patent damages and fraudulent transfer damages. His background includes the analysis of economic, financial, marketing and other business information to assess the economic impact of business events and negotiation decisions. He often advises clients on business valuation and the valuation of business and intellectual property assets in connection with licensing and joint venture transactions, commercial disputes, shared-based compensation agreements, capital raising activities, merger and acquisitions, and inter-company and other transactions. Focusing on the technology and energy sectors, Mr. Leathers has participated in license negotiations for technologies ranging from semiconductor manufacturing to protein therapy, and is often asked to provide expert testimony on issues related to lost profits, business and intellectual property valuation, reasonable royalties, misappropriation of trade secrets, shareholder disputes, and various oil and gas related contracts. Mr. Leathers has been retained by boards of directors and special committees to perform financial and forensic investigations regarding allegations of breach of fiduciary responsibility, irregularities, suspected violations of the Foreign Corrupt Practices Act (FCPA), and in connection with instances of suspected embezzlement or other related fraudulent activity. Earlier, he led the legal and economic consulting practice for a global boutique consulting firm. His previous roles include managing director with Huron Consulting Group, VP with Charles River Associates, a principal and senior consultant with PwC. He also held various financial, accounting and management positions in banking. Mr. Leathers earned a bachelor’s degree in business administration and finance from the Hankamer School of Business, Baylor University. He participated in post-graduate studies and executive education at the Bauer College of Business, University of Houston, and the Jesse H. Jones Graduate School of Management, Rice University. He is an Accredited Senior Appraiser and a Certified Fraud Examiner.
